This Privacy Policy explains how personal information is collected, used and disclosed when you visit or shop at the Ellis & Vane online store (the "Services"). Ellis & Vane is a brand operated by Montavo VOF, a general partnership registered in the Netherlands (Chamber of Commerce/KvK number 42055328) ("we", "us", "our"). Montavo VOF is the controller of your personal information for the purposes of this policy.

Personal information we collect

• Contact details such as your name, billing and delivery address, phone number and email address.
• Order and transaction details such as the items you view, add to your cart, buy, return or exchange, and your order history.
• Payment information. Payments are processed by our payment providers through Shopify's secure checkout. We do not store your full card details.
• Account details if you create an account, such as your login details and preferences.
• Communications you send us, for example when you contact customer service.
• Device and usage information such as your IP address, browser and device type, and how you interact with the Services, collected through cookies and similar technologies.

How we collect it

We collect information directly from you (for example when you place an order, create an account, subscribe to emails or contact us), automatically when you use the Services, and from service providers who help us run the store.

How we use your personal information

• To provide the Services: process payments, fulfil and deliver orders, handle returns and refunds, manage your account and send order-related messages.
• For customer service: to respond to your questions and requests.
• For marketing: to send you marketing emails or other messages where you have agreed to receive them. You can unsubscribe at any time using the link in our emails.
• For security and fraud prevention, and to protect the Services, our customers and our business.
• To comply with our legal obligations and to enforce our terms.

Where the EU General Data Protection Regulation (GDPR) applies, we rely on the following legal bases: performance of a contract (to process your order), our legitimate interests (for example security, fraud prevention and improving the Services), your consent (for example for marketing and non-essential cookies) and compliance with legal obligations.

How we share personal information

We share personal information only where needed for the purposes above, including with:

• Shopify, which hosts our store, and our payment providers;
• delivery and logistics partners, to send your order to you;
• service providers that support our business, such as IT, email, analytics and customer-service tools;
• authorities or other parties where required by law or to protect our rights.

We do not sell your personal information.

Relationship with Shopify

International transfers

We are based in the Netherlands and our service providers may be located in other countries, including countries outside Australia and outside the European Economic Area. Where we transfer personal information internationally, we use appropriate safeguards, such as the European Commission's standard contractual clauses, where required.

We and our service providers use cookies and similar technologies to make the store work, remember your preferences and, with your consent where required, for analytics and marketing. You can manage cookies through your browser settings and, where available, our cookie banner.

How long we keep information

We keep personal information for as long as needed to provide the Services, maintain your account, comply with legal, tax and accounting obligations, resolve disputes and enforce our agreements.

Your rights

Depending on where you live, you may have the right to access the personal information we hold about you, ask us to correct or delete it, object to or restrict certain processing, receive a copy of your information, and withdraw your consent at any time. If you are not satisfied with our response, you can lodge a complaint with a data protection authority, such as the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) or, if you are in Australia, the Office of the Australian Information Commissioner (OAIC).

Children

The Services are not intended for children, and we do not knowingly collect personal information from children.
